Terms of Service and Agreement

Please review these Terms of Service (“Terms”) diligently before engaging with the inspection services (“Service”) provided by W. Capital Automotive Limited, operating as Greasemonkey Inspectors (“Company,” “We,” “Us”). By placing an order, scheduling, or making payment for our Service, you (“Client,” “You”) are indicating your binding acceptance of these Terms.

I. Defined Scope and Nature of the Service

The Service provided by the Company is fundamentally a limited, visual, non-intrusive examination of a pre-owned vehicle, strictly assessing its condition at the moment of the inspection.

  • Visual and Non-Dismantling: Our inspection personnel execute a visual check of readily accessible components. We do not dismantle, disassemble, remove, or otherwise compromise any vehicle parts, panels, or covers.
  • No Destructive Assessment: The Service does not include any form of destructive testing. The integrity of structural components (e.g., frame) is determined only by visual assessment.
  • Temporal Limitation (Point-in-Time Report): The Inspection Report (“Report”) accurately reflects the vehicle’s state solely at the specific date, time, and mileage recorded. The Company bears no responsibility for any subsequent failures, defects, or changes in the vehicle’s condition that occur after the Service is finalized.
  • Used Vehicle Acknowledgement: The Client recognizes that used vehicles inherently sustain wear and tear and may contain latent defects that are not reasonably identifiable during a visual, non-dismantling inspection.

II. Service Exclusions and Limitations of Verification

The Company’s Service and the resulting Report expressly exclude the assessment, verification, or confirmation of the following elements:

  • Legal and Ownership Status: We do not verify vehicle registration, lien status, branding (e.g., “salvage,” “rebuilt”), or actual legal ownership.
  • History Verification: We do not verify police records, accident history, insurance claims, or maintenance logs. Any supplementary third-party history reports (e.g., CarFax, Vin Audit) are provided “as-is” and are not guaranteed by the Company.
  • Emissions Compliance: We do not perform emissions testing and offer no assurance that the vehicle will successfully pass any required provincial standards.
  • Manufacturer Recalls: We do not check for or confirm any open manufacturer recall campaigns.

III.  Understanding Subjective Content

The Client agrees to interpret the subjective elements of the Report as follows:

  • Estimates are Projections, Not Quotes: Any repair cost estimates included are non-binding, rough informational projections based only on visually apparent defects. They do not constitute formalized repair quotations. The final costs determined by a licensed mechanic after a proper diagnostic procedure may vary significantly.
  • Ratings are Subjective Opinions: Any assigned numerical ratings or qualitative terms (“Good,” “Excellent”) represent the subjective assessment of the inspecting technician at that time. They must be evaluated in conjunction with the full, itemized list of specific defects and comments provided in the Report.

IV. Absence of Guarantee and Warranty

The Service and Report are furnished to the Client on an “as-is” and “as-available” basis, without any representation or warranty, express or implied.

  • No Guarantee: The Company provides no guarantee, representation, or warranty concerning the future reliability, performance, or sustained condition of the vehicle. Our Service is designed to mitigate purchase risk, but it does not eliminate it.
  • No Warranty: The inspection Service itself does not include or imply any warranty on the vehicle or any of its components. Separate warranty products, if offered, are distinct and governed by their own specific terms.

V. Limitation of Liability

The Client acknowledges that the final decision to purchase or decline any vehicle rests exclusively with the Client. The Client assumes all risks associated with the transaction.

To the fullest extent permitted by applicable law, the total cumulative liability of W. Capital Automotive Limited, including its personnel and representatives, for any and all claims, damages, losses, or expenses arising from or relating to the Service or the Report, shall be strictly limited to the total amount paid by the Client for that specific Service.

Refund and Credit Protocol

This protocol defines the specific conditions under which a monetary refund or service credit may be issued following the purchase of the Service.

I. Remittance and Finality of Transaction

All payments for the Service are considered final and non-refundable, subject solely to the specific exceptions detailed below.

II. Vehicle Unavailability Prior to Inspection

If the scheduled vehicle is sold or otherwise unavailable prior to the arrival of our inspector at the seller’s location:

The Client will receive a full service credit. This credit is transferable and can be applied toward the full cost of an inspection for a subsequent vehicle at any future time by referencing the original order number.

III. Failed Inspection Due to Third-Party Interference

If our inspector arrives at the scheduled location on time but is prevented from completing the Service due to an issue originating with the seller or the Client:

The Client retains the right to reschedule the inspection for another available date. However, due to the non-recoverable operational costs incurred during the initial visit, this rescheduling will require the Client to pay an additional administrative fee.

IV. Policy on Post-Reservation Cancellation

Once a reservation is confirmed, the Company immediately allocates and schedules resources (technician time and travel logistics). Consequently, a Client-initiated cancellation after making a reservation renders the Client ineligible for a monetary refund.

The Client’s available options following such a cancellation are:

  1. Retention of Credit: Maintain a service credit for application toward a future vehicle inspection.
  2. Booking Transfer: Transfer the entire inspection booking to another individual.
